Certain unclassified staff who are management exempt, unrepresented or confidential exempt also submit the blue payroll cards in accordance with these guidelines. See "Benefits for Managerial and Confidential Exempts" at **THIS LINK** for more information. Variations from the procedures include the following:
Payment for accruals upon leaving the University. The employee or the employee's estate, if deceased, is entitled to full pay for each unused vacation day up to a maximum of 60 days.
Determination of length of workday for unrepresented staff. Staff
in University Educational Assistant (UEA) titles in administrative offices
are paid for a 40-hour workweek. Any determination of pro-rated time
for these employees is based upon an 8-hour day.
| 6.1 | Each employee shall be entitled to an annual vacation according to the following schedule: |
| a. | Twelve-month employees shall receive 1.75 vacation days credit for each month of employment, plus one additional day for a total of 22 days maximum per year. | |
| b. | Employees working fewer than 12 months (including 9 or 10-month employees who are paid on a 12 month basis) shall accrue vacation on a prorated basis. Employees employed on a part-time basis shall accrue vacation on a prorated basis. | |
| c. | Recognizing that large vacation accumulations are to be used during
departmental slow times, all employees may accumulate vacation credit of
up to 60 vacation days, except as noted below:
Vacation days may not be accumulated beyond this amount except by specific permission of a University Vice President, Director or designee. It is understood that employees who have previously accumulated more than the 60 days may retain this accumulation provided that in no case may the employee's accumulation exceed the number of days he/she presently has. The original entitlement over 60 days diminishes upon use until it reaches 60 days. (It does not remain as a permanent entitlement with additional possibility of accrual.) Once below 60 days, it cannot be accumulated beyond 60 again. An employee whose reasonable request for vacation time has been denied shall be permitted to accrue that time beyond the 60 days. |
|
| d. | A legal holiday, as enumerated in Article 8 below, that occurs during the employee's vacation shall not be charged against the employee as a vacation day. | |
| e. | To the extent possible, consistent with a department's workload, the choice of vacation periods shall be up to the individual employees. In the event of unresolved conflicts over vacation schedules between two or more employees within the same department, preference shall be determined by seniority within the department provided that the final decision shall be based on the needs of the department and shall be determined by the appropriate Dean, Director or Department Head. Employees may take up to 3 vacation days per calendar year without requesting them in advance from their Dean, Director or Department Head. | |
| f. | If any employee's service is terminated for any reason, the employee (or the employee's estate if deceased) shall be entitled to receive full pay for each unused vacation day up to 44 days. | |
| g. | If an employee becomes ill or is injured while on vacation, such time shall be charged against sick leave, provided that if requested the employee provides the appropriate dean, director or department head with medical documentation of said illness or injury. |
Normally, terminating employees are considered to terminate at the conclusion of their last day at work. Such employees shall not be carried on accrued vacation time for the purpose of gaining holiday pay or for completing the month to gain additional vacation accrual. The appropriate Vice President, Director or designee (Article 7.1) may waive this requirement. Exceptions to this include employees who retire on the last day of the month and employees who are on unpaid leave. UCPEA end date staff whose appointments are not renewed are also an exception, provided they do not resign in advance of their end date. Questions concerning vacation accruals for terminating employees may be directed to the Payroll Office.
Vacation credits are added at the end of the month and are not used prior to the first day of the succeeding month. One additional day is added on the card, which includes December 31 and is not used until after January 1.
Full-time employees should mark their use of vacation time on the leave record in increments of no less than 1/4 of a day.
Twelve-month part-time (50% or more) employees accrue vacation credit on a prorated basis of the full-time rate, earning and using hours rather than days. The following formula shall be used to determine the approximate accrual rate: 7 (hour day) x 1.75 = 12.25 hours (full time) x % employed = accrual rate in hours (round on third decimal). Example: 7 x 1.75 = 12.25 x 75% = 9.188 hours. The year-end addition of the extra day would be 5.25 hours for that same 75% employee (7 hours x 75% = 5.25).
With this exception reporting system, the Payroll Department has no knowledge of the basic schedule of each part-time (50% or more) employee; therefore, on the day the employee uses vacation, indicate the hours to be charged along with the vacation symbol, i.e., 6.50 V. The total of such hours should be subtracted on the face of the card.
Part-time (50% or more) employees should mark their use of vacation time in increments of no less than one hour.
The maximum vacation accrual in a calendar year is 60 days, except by special permission of a University Chancellor, Vice President, Director or Designee. The only exceptions are the few cases where a "grandfathered" amount from prior to July 1, 1977 has been accepted. Since the 60 days is a calendar year maximum, an employee may exceed the maximum at any time during the year (but not more than 120 days), provided that the year-end (December 31) balance does not exceed 60 days. When an employee receives permission to exceed the maximum, the written approval should include the date by which the accrual will be reduced to the contractual maximum. Once below 60 days, it cannot be accumulated beyond 60 again.
Note: Under Article 6.f an approval to carry over more than 60 vacation
days at the calendar year end does not supersede the provision of the UCPEA
collective bargaining agreement to pay up to 44 vacation days to a terminated
employee.
| 8.1. | Each employee shall be entitled to time off with pay for
each legal holiday listed herein or any other legal holiday declared by
the Governor or General Assembly.
LEGAL HOLIDAYS: New Year's Day, Martin Luther King Day, Lincoln's Birthday, Washington's Birthday, Good Friday, Memorial Day, Fourth of July, Labor Day, Columbus Day, Veteran's Day, Thanksgiving Day, Christmas Day. If such a holiday falls on a Saturday, it shall be observed on the preceding Friday. If such a holiday falls on a Sunday, it shall be observed on the following Monday. In order to provide additional flexibility to the professional staff, Good Friday is designated a "floating" holiday which may be taken at a time mutually agreed to by the employee and his/her supervisor. Any employee required to work on a legal holiday shall be granted a compensatory day for that holiday to be taken by the end of the succeeding calendar year at a time mutually agreed to by the parties. In order to earn a day for use as a religious holiday, an employee may request to work a holiday on which his/her department is open. |
| 8.2. | Part-time employees shall be granted time off with pay on a prorated basis for holidays. Employees who work less than a full-time five-day workweek over 12 months will receive all 12 holidays on a pro-rated basis. |
When a designated holiday is worked, the appropriate day on the calendar should be marked "+H" and proper credit indicated in the "earned" space of the holiday column.
When a previously earned holiday is used, the notation on the calendar should be "-H" and the "taken" space of the holiday column notated accordingly.
Full-time employees should mark their use of holiday time on the leave record in increments of no less than 1/4 of a day. Employees whose full-time schedule is on a flexible arrangement accrue holiday credit if a holiday falls on a day they are not scheduled to work.
Should a designated holiday fall on a day when an employee is absent on any other paid leave, the holiday shall be treated as though the employee were absent from work for the purpose of observing that holiday and not charged to other leave time. The only exception to this is unpaid leave, when the working days before and after the holiday are unpaid leave. No holiday credit is given in the latter instance.
The use of the "floating" Good Friday holiday should be identified, if used before the designated day of observance, by the symbol "GFH". If used after that date, record it as any other previously earned holiday. It may not be used prior to January 2nd of the calendar year in which it falls.
On January 1 of any year, an employee may carry over earned holiday
accruals only for holiday time earned in the preceding year. Any
accruals remaining from the second preceding year shall be dropped.
For example, at the end of 2002 all holiday credits earned in 2001 must
be dropped. A resigning or terminating employee shall
be paid for the value of any holiday accrual remaining on the last day
of work. Holiday accruals while on a State Voluntary Leave or Schedule
Reduction differ from these procedures. Please refer to the Voluntary
Leave regulations at http://www.hr.uconn.edu/volredpr.html.
Should a part-time employee's regular schedule on a holiday call for a number of hours more than the value of a holiday, other accrued time is used to bring the day up to the total hours in the regular schedule. For example, the 75% time person who is regularly scheduled to work 7 hours on a Monday on which a holiday falls and who takes the day off, would indicate 5.25 H and use -1.75 vacation or other accrued time to account for a 7 hour day taken off from work.
If that same 75% employee worked a regular 7-hour schedule on the holiday, a prorated accrual of 5.25 hours would be added to the holiday column. If a holiday falls on this employee's normal day off, the individual would earn the pro-rated holiday and add 5.25 hours to the holiday column.
Entries for some part-time (50% or more) employees do not necessarily
reflect their true leave status, but serve to maintain a proper account
of accruals and/or use. Part-time employees should mark their use
of holiday time in increments of no less than one hour.
| 9.1 | Each employee in the bargaining unit shall be entitled to 1 and 1/2 days per year for emergencies or personal business. Employees shall be expected to notify their supervisors of their anticipated absence as early as possible. Personal leave is not accrued. |
Both full-time and part-time (50% or more) employees receive 1 and 1/2 days of personal leave per contract year. For individuals with days of varying length, their ordinary workday is considered a day of personal leave time.
The "EML" column on the leave record is notated when personal leave is used. On each July 1 the card that includes that date should show 1 1/2 days as a beginning balance of personal (EML) leave time.
Those part-time employees who normally indicate accruals and use of
vacation and holiday time in hours should maintain their use of personal
leave time in days.
| 10.1. | Jury Duty or Court Appearances under Subpoena:
Each employee called as a juror or subpoenaed to appear in court for reasons resulting from his/her University employment, shall be granted leave for that purpose at no loss of pay or charge to other leave, provided that: |
| a. | the employee notifies the appropriate department head within four (4) days of receiving notification to serve as a juror or of receiving the subpoena; | |
| b. | the employee either refuses pay, excluding mileage, for serving on a jury or turns the jury pay over to the University. |
The calendar side of the leave record is coded "JD" for days served
on jury duty or under a work-related subpoena. Any day on which an
employee is excused from jury duty or court appearance and not paid will
be charged to either accrued vacation, holiday or personal time, if the
employee does not report to work.
| 10.2. | Civic Emergencies:
Employees who are fire, ambulance or other recognized emergency personnel and who have so notified their supervisors in advance, may request time off for emergency duty. Approval of each request for emergency duty is solely at the discretion of the first level supervisor outside the bargaining unit. Up to five (5) requests per year may be granted with pay. Additional approved requests shall be charged to vacation time. The denial of time off for civic emergencies is not grievable or arbitrable under this contract. |
The supervisor responsible for approving time off for such emergencies
is responsible for the implementation of these controls.
| 11.1. | The University recognizes its obligations to provide paid and unpaid sick leave for bona fide personal illness to members of the professional staff. |
| a. | Full-time employees shall receive paid sick leave for bona fide personal illness up to fifteen (15) workdays per contract year. Part-time employees, including those working less than 12 months, shall have it prorated. Sick leave may also be used for illness or death in the immediate family; however, from the 15 days, leave for these categories shall not exceed 5 days in a fiscal year, except for illness of one's child and/or parent, which shall not exceed 10 days in a fiscal year. Immediate family shall mean parent (guardian, step-parent), parent-in-law, spouse, son or daughter, step son or step daughter, son-in-law, daughter-in-law, stepson-in-law, stepdaughter-in-law, sibling, sibling-in-law, grandparent, grandparent-in-law, niece, nephew, aunt, uncle, or any person living with the employee. Employees shall be allowed to use sick time for doctors' appointments for themselves, the employee's mother, father, or child, or any person living with the employee. |

Full-time staff mark their use of sick time in increments of no less than 1/4 of a day.
Supervisors should direct employees with serious or chronic health conditions to the Leave Administrator in Human Resources at 486-0410. This will ensure the University's compliance with Federal and State Family and Medical Leave (FMLA) laws. Refer to http://www.hr.uconn.edu/loa.html for additional information.
Once the first 15 days have been exhausted, employees may make a written request for additional paid time by accessing their "as if accrued" sick time (based on prior use of sick time in UCPEA) or prior "banked" classified time. Once the Dean or Director approves, the leave record must be signed by two supervisors/managers, including the approving Dean or Director, before it is sent to the Payroll department. The approval form must be sent to Human Resources for notification to the Board of Trustees.
Since there is no accrual of sick leave, separating employees will not
be paid for unused sick leave. Some retiring employees may be eligible
for payment of one quarter (1/4) of "banked" sick leave time that was banked
for them when they left classified State service, up to a total of 60 days.
The Payroll Department maintains the records for prior "banked" sick time
from classified service.
| 11.1 | b. | Decisions as to the granting of paid or unpaid sick leave
for bona fide personal illness, with the use of sick days during a fiscal
year exceeds 15 workdays, shall be made by the University Administration
coordinated by the Department of Human Resources. Whether for paid
or unpaid leave after fifteen (15) days each case shall be reviewed separately
by the University Administration coordinated by the Department of Human
Resources based on a careful consideration of length of service, nature
of the illness, anticipated length of the illness and previous use of sick
time.
When accompanied by a medical certificate (http://www.hr.uconn.edu/forms.html), if requested, and having made adjustments for past use of sick leave, the Department shall grant an employee who requires it, no less sick leave than they would have been eligible for had the University had an accrual sick leave system. |
| c. | Before being granted, all requests for sick leave must be approved (by the first level super-visor outside the bargaining unit) as a bona fide illness which prevents an employee from carrying out his/her responsibilities. A medical certificate may be required for any illness regardless of the number of days. | |
| d. | Applications for sick leave in connection with childbirth shall be considered on the same basis as leave requests for any other sick leave. |
| 11.2 | In cases where employees have been allowed to accumulate unused sick leave days, such days shall remain "banked". Employees whose need for sick time for bona fide personal illness exceeds what they would have been entitled to under an accrual system shall, at their option, be entitled to use any banked time. At the time of retirement, any unused "banked" days an employee has remaining shall be subject to the provisions of Section 5-247 of the State Personnel Code dated July 1, 1975. No employee shall be forced to use his/her banked sick time. |
NOTE regarding prior "banked" sick leave:
Sick leave that an employee would have been eligible for had the University
had an accrual sick leave system, "as if accrued" sick leave, and prior
"banked" sick days are separate and mutually exclusive. Prior "banked"
sick time is available only to certain employees as follows:
| a. | When an employee moves from a classification that permits the accrual of sick time (usually a State classified position) to a class covered by the UCPEA contract, his/her accrual will be frozen and "banked". |
| b. | When an employee has been allowed to accumulate unused sick leave prior to July 1, 1977 and had a remaining balance on July 1, 1979, such remaining balance remains "banked". |
Part-time employees should mark sick time as used in increments of no
less than one hour.
| 11.3 | SICK LEAVE BANK |
| a. | The Sick Leave Bank, established effective November 1997, consists of time made available by the donation of accrued vacation or holiday time by members of the bargaining unit. | |
| b. | Donation of time may occur in July and the last pay period in December and shall be either one-half or one-day increments. Access to the bank shall be under guidelines developed by UCPEA and the University. (http://vm.uconn.edu/~ucpea/poliform) Each year of the contract, the University shall match on a one-to-one basis, donations by UCPEA members, up to a maximum of the equivalent of 20 donated days | |
| c. | The Sick Leave Bank shall be available as a source of sick time when all other options are exhausted. The University shall consider sick time under Article 11.1.a and b prior to application under the Sick Leave Bank. This consideration shall include any additional days the University may be willing to grant for very serious or catastrophic illnesses or injuries as paid sick time beyond any banked or "as if accrued" sick time. The University may also grant, solely at its discretion, additional paid sick time beyond any allotted from the Sick Leave Bank. Consideration of additional paid sick time shall be coordinated by the Department of Human Resources. |
| 11.4 | WORKERS' COMPENSATION |
When an employee is out of work due to a work-related injury or illness,
the procedures and provisions of the Workers' Compensation Statutes will
be followed. Should an employee's absence be for less than the duration
required for Workers' Compensation coverage to begin, the use of either
existing or "as if accrued" sick time shall not disadvantage any future
needs for sick time up to the amount utilized. If an employee chooses
to supplement the Workers' Compensation pay with his or her own time balances
up to 100% of salary, that time shall be deducted and will not be available
for future utilization.
| 12.1 | The University shall grant an employee giving birth to a child up to thirty (30) workdays of paid leave related to childbirth. Such leave shall be subtracted from her sick leave entitlement to the extent that it exists, including "as if accrued" and previously earned banked sick leave. Time characterized as maternity leave related to childbirth shall commence on the date of birth and extend 30 workdays thereafter. Unpaid time, either preceding or following the birth, shall be considered as medical or family leave, as appropriate. |
| 12.2 | The University shall grant an employee up to 5 workdays
paid leave at the time of birth, adoption, or taking custody of a child,
or for the prenatal or postnatal care of a spouse or significant other.
Such leave shall be subtracted from her/his sick leave entitlement, if
it exists, and shall be deducted from that portion of the employee's sick
leave available for illness of a child.
Employees shall be entitled to use up to 30 workdays of accrued time (i.e. vacation, compensatory time, holiday time, personal leave) at the time of birth or adoption. This is not subject to management approval nor shall the employee be required to use accrued time in conjunction with unpaid leave. |
| 12.3 | Upon expiration of paid leave following the birth or adoption of a child, the employee is entitled to up to twenty-four (24) weeks unpaid leave, with her/his position held, per C.G.S. 5-248a. |
| 12.4 | Following the birth or adoption of a child, parents who do not wish to take a leave of absence without pay as in 12.3 above, nor to return to work full-time, shall be entitled to work half-time for up to six (6) months. Employees may request to work half-time for up to 12 months; any leave beyond the first six months shall be subject to management approval. Approved time utilized during the second six months will be counted toward the employee's entitlement under the Family and Medical Leave Act. |
The date of a half time return to work (Article 12.4) will begin upon the expiration of the sick leave entitlement for the birth of a child. The half-time return to work is intended as an alternative to an unpaid family leave under the State's FMLA regulations. Employees normally are not permitted both of these arrangements.
The 30-day maternity leave will be extended by the number of holidays
that occur during the leave. In the case of a Cesarean delivery,
the University customarily provides an additional 10 days of maternity
leave. The payroll code for maternity leave is MLS. For the
5 days of paid leave the father may use at the time of birth, the payroll
code is BL.
| 7.1 | Employees intending to leave the employ of the University must give one month's notice in advance. After giving notice, such employees must serve at least 10 workdays on the job prior to leaving. Employees serving less than 10 workdays on the job shall forfeit one day of paid vacation for each day less than 10 workdays on the job. The appropriate Vice President, Director or designee may waive this requirement. |
Employees should keep in mind that their last day at work (except for retirements on the last day of the month and end date non-renewals) is their last day on the payroll. Accrued vacation or other leave balances may not be used to extend one's time on the payroll (see "Vacation Leave Procedures" above) for the purpose of gaining holiday pay or for completing the month to gain additional vacation accruals. Terminating employees are eligible to receive pay for unused vacation days and holidays, subject to the terms of Articles 7.1 and 6.1.f. No other leave time is paid off (see "Compensatory Time", Article 18 for specific rules). Questions concerning vacation accruals for terminating employees may be directed to the Payroll Office.
It is important that a copy of the letter of resignation and the Department
Head's forwarding memo to the Dean or Director is sent at once by the Department
Head to the Payroll Department. In the event of short notice, a phone
call to Payroll is in order.
| 18.1 | NON-EXEMPT EMPLOYEES - Compensatory time for non-exempt
employees shall be in accordance with the Fair Labor Standards Act.
Appendix A Compensatory Time for Non-Exempt Employees: Compensatory time for non-exempt employees shall be afforded in accordance with the Federal Fair Labor Standards Act as summarized in the following guidelines: |
| a. | Compensatory time shall be afforded at the rate of one and one-half hours for each hour for which overtime compensation is required by FLSA. | |
| b. | When an employee's compensatory time earned under Article 18 (Compensatory Time) reaches a total of 240 hours, the employee shall be paid for additional compensatory time earned. | |
| c. | The University may elect to reimburse an employee for any unused compensatory time at any time, at its option. | |
| d. | To the extent possible, consistent with a department's workload, the choice of when to use accrued compensatory time shall be up to the employee. | |
| e. | Upon termination of employment for any reason, an employee shall be reimbursed for any unused compensatory time. |
When non-exempt employees use earned compensatory time, they will mark the face of the card on the appropriate day with the number of hours used and "CU". For example, if an employee used 7 hours of compensatory time on the first Tuesday of the pay period, mark "7 CU" for the first Tuesday. Make the corresponding deduction in the "C-TIME IN HRS" column.
Compensatory time for non-exempt employees is earned for hours worked over 40 in a week. Paid or unpaid time off during the week is not considered time worked. For example, an employee works 10 hours on Monday and Tuesday, on Wednesday uses 7 hours of vacation time. The rest of the week the employee works 7 hours a day. No compensatory time is earned for this week since total hours worked would be only 34.
Since compensatory time is based on total hours worked per week, not
per day, supervisors must keep an internal record of hours worked each
day and transfer hours over 40 to the back of the time card at the end
of each week. Hours worked from 35 through 40 each week are
NOT included on the payroll card as compensatory time.
| 18.2 | EXEMPT EMPLOYEES
Whenever an exempt employee is required to work extraordinary hours with the prior approval of a supervisor outside the bargaining unit, compensatory time shall be afforded. When compensatory time is afforded it shall be equivalent to the extraordinary hours worked. The following procedures shall be followed: |
| a. | A standard approval form shall be jointly completed by the employee and the first manager (or designee) outside the bargaining unit specifying the reason for the requirement and indicating the prior approval. | |
| b. | All compensatory time must be recorded on the employee's leave record as it is earned. | |
| c. | Each department shall track compensatory time balances. | |
| d. | All time must be utilized within two years of being earned at times mutually agreeable to the employee and the supervisor. |
Under Article 18.3 if an individual employee's accumulation of compensatory
time exceeds a balance of 140 hours, management may opt to pay for the
time over 100 hours up to a maximum of 40 hours at a time.
| 1. | Each pay period, when compensatory time is earned, the pre-approved hours will be recorded under "C-TIME IN HRS" in the "earned" box. (Note that the reverse side of the leave record is for non-exempt employees only.) |
| 2. | Each pay period, when compensatory time is used, employees will indicate "CU" with the number of hours used on the calendar side of the leave record, as well as deduct the hours in the "taken" box. |
| 3. | Departments are required to maintain the "Request for Approval of Compensatory Time Accrual" form found at http://www.hr.uconn.edu/loa.html which authorizes an employee to work extraordinary hours. |
| 4. | When management opts to pay out compensatory time, the "Authorization for Payment of Earned Compensatory Time for UCPEA Employees" form found at http://www.payroll.uconn.edu/professional.html must be completed and forwarded to the Payroll Department, along with the leave record for the pay period in which this payment is being made. The hours being paid must be deducted in the "taken" box on the leave record. |
| 5. | Compensatory hours that remain on the leave record when an employee separates from the University will not be paid out, unless authorized as described in #4 above. Employees who transfer to another State agency will not be allowed to "carry" their compensatory time with them. |
